A Significant Success Before the Hon’ble Supreme Court of India

We are delighted to share yet another significant achievement before the Hon’ble Supreme Court of India in Criminal Appeal arising out of SLP (Crl.) No. 6760 of 2026, wherein the Hon’ble Supreme Court of India, vide order dated 04 June 2026, was pleased to allow the appeal, grant regular bail to the appellant Mr. Sandeep Sadashiv Surve, and set aside the judgment and order dated 11.03.2026 passed by the Hon’ble High Court of Judicature at Bombay rejecting his bail application.

The matter arose from FIR No. 140 of 2022 registered at Nerul Police Station, Navi Mumbai, involving allegations under Sections 406, 409, 420 read with Section 34 IPC and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999, concerning alleged deposits collected from numerous investors. Despite repeated rejection of bail by the Courts below and serious opposition from the prosecution, the defence successfully demonstrated before the Hon’ble Supreme Court that continued incarceration was unjustified in the facts and circumstances of the case.

After hearing the parties and examining the material placed on record, the Hon’ble Supreme Court was pleased to hold that the appellant had made out a case for interference with the impugned judgment and, considering the totality of circumstances and the period of custody undergone, granted regular bail subject to conditions imposed by the Trial Court. The Hon’ble Court further directed expeditious trial and set aside the impugned order of the Hon’ble Bombay High Court.

This result reaffirms the fundamental constitutional principle that personal liberty cannot be curtailed indefinitely and that bail jurisprudence must be guided by fairness, proportionality, and the settled principle that pre-trial detention cannot become punitive in nature.
